Eviction Move Outs

Writs of Restitution will be issued only upon the written request and the payment of the filing fee by the prevailing party. Requests to issue Writs of Restitution shall be filed only after the Judgment for Restitution has been docketed by the Clerk.

Move outs are conducted within 10 days after service of the writ and are set at the convenience of the court.

If you are the Landlord the day after applying for your Writ of Restitution please call the bailiff at 440-953-4165 to obtain the move out date. The plaintiff is responsible to arrange for the moving and storage of items, items to be stored must be stored in a secure facility. Items are NOT to be set out on the street. The costs for move out can be added to the plaintiff's second cause of action, if any.

On the move out date if the tenant is not present the landlord may take possession of the property. If the tenant is present please call the bailiff's office at 440-953-4165 by 9:00 a.m. on the day of move out to make an appointment to have a bailiff present. A bailiff will respond only if the tenant is present.
